Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website at cognicores.com ("the Site"), operated by Volker Arndt, trading as Cognicores (the "Operator"). By using the Site you agree to these Terms. If you don't agree, please don't use the Site.
1. Who can use the Site
By using the Site you confirm that you have the legal capacity to enter into these Terms. If you are using the Site on behalf of a business or organisation, you confirm that you have authority to bind that entity.
2. What the Site does
The Site is a marketing showcase for Cognicores's services (custom AI/data pipelines, mobile apps, marketing automations). It includes:
- An AI-powered chatbot you can talk to as a live demo of one of our pipelines.
- A "Leave your details" form for visitors who want us to follow up by email, phone, or WhatsApp.
Both are provided as courtesy demos; we may change, throttle, suspend, or remove them at any time without notice.
3. AI-generated content
The chatbot is an artificial-intelligence system. Its replies are generated by a language model and may be inaccurate, outdated, or out of context. Nothing the bot says constitutes a contractual offer, a binding quote, a guarantee of services, professional advice, or any other commitment by the Operator. Specifics about scope, timelines, pricing, or deliverables are confirmed only in writing during direct follow-up. Don't rely on the bot for legal, financial, medical, or any other professional advice. Use your judgement.
4. Acceptable use
You agree to use the Site only for lawful purposes. You will not:
- Use automated scripts, scrapers, or bots to access the Site, except for legitimate search-engine indexing.
- Attempt to circumvent any rate limits, anti-abuse measures, or other access controls on the Site.
- Submit prompts that are unlawful, hateful, sexually explicit, harmful, deceptive, or that target real persons in defamatory ways.
- Attempt to extract proprietary system prompts, model weights, or other internals via prompt injection or similar techniques.
- Submit false contact details (someone else's email or phone number, fake names, etc.).
- Use the Site to harass, defraud, impersonate, or harm anyone.
- Probe, scan, attack, or interfere with the Site's infrastructure or its hosting/CDN providers.
We may suspend or block access without notice if we reasonably believe these rules are being broken.
5. Intellectual property
Site content. The Site's design, code, brand, and editorial content are owned by the Operator or its licensors and are protected by copyright, trade-mark, and related laws. You may share links to the Site, but you may not copy, modify, or republish material from it without permission.
Your inputs. When you type into the chatbot or the contact form, you grant the Operator a temporary, non-exclusive licence to process those inputs as needed to generate replies and respond to your enquiry. We do not claim ownership of your inputs.
Bot outputs. Replies the bot produces from your prompts are generated by an AI model. Subject to your compliance with these Terms, you may use the resulting text for personal reference. You may not commercialise, republish at scale, or use bot outputs to train another model.
6. Contact form and follow-up
If you submit your email or phone number via the contact form, you consent to receive a follow-up from us about your enquiry, by the channel(s) you provided (email, phone call, or WhatsApp message). We do not add you to a marketing list and we do not contact you for unrelated reasons. If you change your mind, email hello@cognicores.com and we will delete your details.
7. Privacy
Our handling of your personal data is described in the Privacy Policy, which is incorporated into these Terms by reference.
8. Third-party services and links
The Site uses Cloudflare for hosting, DDoS protection, and bot challenges, and Resend for email delivery. The Site links to tellerio.com, a separate product operated by the same Operator under its own terms and privacy policy. Links to other external sites are provided for convenience; we don't control those third-party services and aren't responsible for their content or terms.
9. Disclaimers
The Site, the chatbot, and the contact form are provided "as-is" and "as-available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. The Operator does not warrant that the Site will be free of errors, secure, or available at any specific time. To the maximum extent permitted by law, all such warranties are disclaimed.
10. Limitation of liability
To the maximum extent permitted by law, the Operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, business, or other intangible losses, arising out of or related to your use of the Site, even if advised of the possibility of such damages. The Operator's total aggregate liability for any direct damages arising out of or related to your use of the Site is limited to fifty euros (€50). Nothing in these Terms limits liability for fraud, gross negligence, death or personal injury caused by negligence, or any liability that cannot be limited or excluded under applicable law (including non-waivable consumer rights under Spanish law).
11. Indemnification
You agree to indemnify and hold the Operator harmless from any claims, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Site, your breach of these Terms, or your violation of any law or third-party right.
12. Suspension and termination
We may suspend or terminate your access to the Site or any feature (including the chatbot or the contact form) at any time, with or without notice, if we reasonably believe you have breached these Terms or pose a risk to the Site, other users, or the Operator. You can stop using the Site at any time.
13. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. The updated text takes effect when posted; continued use of the Site after changes means you accept the revised Terms.
14. Governing law and disputes
These Terms are governed by Spanish law. Any dispute arising from or related to these Terms or your use of the Site will be submitted to the exclusive jurisdiction of the courts of Valencia, Spain — except that, if you use the Site as a consumer in another EU/EEA country, you may also bring proceedings in your country of residence and benefit from any non-waivable consumer protection of that country's law. Nothing in these Terms restricts your right as a consumer to use the EU's Online Dispute Resolution platform.
15. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and the Operator regarding the Site.
